herein referred to as PV distributes organic and sustainable beauty products. In particular, PV operates an internet shop which can be found at the address pure-vision.ch.
|2. Scope of application
|PV delivers goods and provides services in Switzerland and Liechtenstein on the basis of these General Terms and Conditions (GTC). GTCs of a Purchaser shall not apply, even if the Purchaser refers to such. Amendments and supplements to these GTC must be made in writing. The prevailing version of these GTCs is its German version.

Products of the following brands are exclusively reserved for professionals (they require advice):

while products of the following brands are accessible for consumers:

- BUBBLEKID (bubblekid.ch)
|An order placed with PV (whether on the Internet by clicking the order button, by WhatsApp, by email, by telephone or verbally) constitutes a binding offer to PV to conclude a purchase contract. The purchase contract is only concluded with the dispatch of the ordered products to the Purchaser , its express acceptance or the provision of the service by PV. PV delivers exclusively to natural persons or legal entities. All information on goods and prices on the PV homepage are subject to change and non-binding. PV confirms the acceptance of the order by e-mail to the Purchaser. If the goods ordered by the Purchaser are not available in the desired quantity or at the price indicated on the homepage, PV shall notify the Purchaser accordingly as soon as possible.
|Orders and deliveries are always made within Switzerland and the Principality of Liechtenstein. Delivery is made from stock in Switzerland as long as stocks are available.
|6. Prices and delivery costs
|The prices in Swiss francs (CHF) at the time of the order apply. All prices are exclusive of VAT. The applicable VAT and any shipping costs for delivery will be added. PV expressly reserves the right to make price surcharges for deliveries, additional services or scheduled and express deliveries. The additional costs will be shown separately on the order confirmation.
|7. Delivery conditions
|PV will make every effort to meet a delivery deadline of max. 48 hours outside weekends and public holidays, as long as the order is received before noon on a given working day. Failure to meet delivery deadlines and dates does not entitle the customer to claim damages or to cancel the order.
|8. Terms of payment
|For private customers, payment for ordered goods is made directly in the internet shop by PayPal, credit or debit cards. For salons, unless otherwise agreed, the invoice is due for payment after 15 calendar days without deduction. Payment shall be made by bank transfer, postal transfer, PayPal or credit or debit card. If the customer does not meet the agreed payment deadline, he shall pay interest on arrears of 5% from the due date without a reminder. Any reminder and collection charges incurred shall be reimbursed to PV by the Purchaser.
|9. Packing & transport
|The ordered goods are carefully packed by PV and the cardboard box is filled with biodegradable corn chips in order to soften shocks during transport. However, the transport is carried out by a third party company so that benefits and risks are transferred to the Purchaser with the departure of the delivery from PV's warehouse. Visible packaging damage or differences in quantity must be reported in writing to PV and the transport company within 48 hours of receipt of the goods. Otherwise the goods are deemed to be faultless and accepted by the Customer. PV will replace missing or damaged goods that have been validly reported as soon as possible.
|10. Retention of title
|PV remains the owner of the goods delivered by it until they have been paid for in full. During the period of default in payment, PV is also entitled at any time to withdraw from the contract, to demand the return of the delivered goods and to claim damages for the loss of the contract.
|In principle, there is no right to return goods. Upon request of the Purchaser, PV may comply with a one-time request for exchange or return of parts of the ordered goods provided that these goods are returned to the warehouse of PV unused, undamaged, complete and in unopened original packaging and at the expense and risk of the Purchaser.
|The Purchaser has the right to complain about damaged goods in order to receive a faultless item. However, the defectiveness of the goods must have already existed at the time of handover of the goods. In the event of a justified complaint under the warranty, PV offers the following options: subsequent delivery (PV takes back the goods and replaces them with an identical but defect-free product), return (PV takes back the goods and refunds the full purchase price to the Purchaser), reduction (the Purchaser keeps the defective goods and receives a part of the purchase amount back from PV in return) or exchange for another product (the Purchaser, if agreeing, receives an equivalent but different product).
|13. Warranty, product liability & damages
|PV distributes in Switzerland and the Principality of Liechtenstein various products manufactured abroad. Claims for damages against PV, irrespective of their legal basis, are excluded. In particular, no liability is accepted for consequential damages arising from the use of the products. This does not apply to liability due to gross negligence. In this case, liability shall be governed by the statutory provisions.
|14. Final provisions
|PV reserves the right to amend the General Terms and Conditions at any time.
Should any provision of these general terms and conditions be invalid, this shall not affect the validity of the remaining provisions or the general terms and conditions as a whole. The relevant statutory provisions shall apply in place of the invalid provision.
|15. Resale of products
|Salons have the right to resell the products purchased from PV to their clients. If they wish to do so via their own internet shop, it must be set up in such a way that the purchasers can only buy via a password-protected area. Furthermore, the salon is prohibited from making the prices of the products public. If the salon does not comply with these rules, PV reserves the right to stop supplying its products to the salon at any time.
|16. Applicable law & place of jurisdiction
|The legal relationship between PV and the Purchaser shall be governed exclusively by Swiss law. For all disputes arising from the business relationship between PV and the Purchaser, the place of jurisdiction shall be the ordinary courts at the domicile of PV in Erlenbach ZH.
|17. Data protection & security
|The Purchaser is aware that his personal data required exclusively for the processing of the order will be stored on data carriers by Shopify (PV's Internet platform). Although Shopify always uses the latest security technologies, no liability can be accepted for the security of data transmitted via the Internet. The transmission of data is not encrypted. The Purchaser expressly consents to the collection, processing and use of his personal data within the scope of PV's business activities.
The Purchaser may revoke this consent at any time with immediate effect for the future. In this case, PV undertakes to delete the personal data immediately, unless a contractual process for which these data are necessary has not yet been fully completed. The Purchaser further has the right to request information about the personal data stored by PV about him at any time and to request that such data be corrected in the event of any errors in such data.
The Purchaser agrees that the data collected by PV may be used for PV's own marketing purposes. PV will not disclose the data to third parties.
